EOS Privacy Notice

This Privacy Notice describes how esh OS LTD. (“EOS”) collects and uses your personal information in relation to EOS websites, applications, products, services, events, and experiences that reference this Privacy Notice (together, “EOS Offerings”).
This Privacy Notice does not apply to the “content” processed, stored, or hosted by EOS customers using EOS Offerings in connection with a EOS account. Please refer to the agreement governing your access to your EOS account for more information about how EOS handles content and how EOS customers can control their content through EOS Offerings. This Privacy Notice also does not apply to any products, services, websites, or content that are offered by third parties or have their own privacy notice.

Information EOS Collect
EOS processes two types of data and information of its customers:
The first type of information is un-identified and non-identifiable information pertaining to a customer(s), which may be made available or gathered via your access to the EOS Offerings (“Non-personal Information”). EOS is not aware of the identity of a customer from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. browser type, language preference, access time, etc.) in order to enhance the functionality of our Offerings. EOS may also collect information on your activity on the various Offerings (e.g. clicks, actions, etc.).
The second type of information is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual (“Personal Information”). EOS Processes your Personal Information in the course of providing EOS Offerings to you.
Your information may be collected or processed by EOS in the following cases when you:
· search for, subscribe to, or purchase EOS Offerings;
- create or administer your EOS account;
- configure your settings for, provide data access permissions for, or otherwise interact with EOS Offerings;
- register for or attend an EOS event;
- purchase or use content, products, or services from third-party in relation to EOS Offerings;
- offer your content, products, or services on or through EOS Offerings;
- communicate with EOS by phone, email, or otherwise;
- complete a questionnaire, a support ticket, or other information request forms;
- post on EOS websites or participate in community features; and
- employ notification services.
- visit, interact with, or use EOS Offerings (including when you use your computer or other device to interact with EOS Offerings);
- download content from EOS;
- open emails or click on links in emails from EOS; and
- interact or communicate with EOS (such as when you request customer support).
Here are the types of information EOS processes:
· Non-Personal Information may include the following, based on the Offerings used by you:
o computer and device information, such as device, application, or browser type and version, browser plug-in type and version, operating system, or time zone setting;
o the location of your device or computer;
o authentication and security credential information;
o content interaction information, such as content downloads, streams, and playback details, including duration and number of simultaneous streams and downloads;
o EOS Offerings metrics, such as offering usage, occurrences of technical errors, diagnostic reports, your settings preferences, backup information, API calls, and other logs;
o the full Uniform Resource Locators (URL) clickstream to, through, and from EOS website (including date and time) and EOS Offerings, content you viewed or searched for, page response times, download errors, and page interaction information (such as scrolling, clicks, and mouse-overs);
o email addresses and phone numbers used to contact EOS; and
identifiers and information contained in cookies.
· Personal Information that you provide directly to EOS may include the following, based on the Offerings used by you:
o Contact information: your name, email address, physical address, phone number, information regarding identity, including government-issued identification information and other similar contact information
o Financial information: payment information, including credit card and bank account information, other corporate and financial information, VAT numbers and other tax identifiers;
o information about your location;
o usernames, aliases, roles, and other authentication and security credential information;
o your image (still, video, and in some cases 3-D), voice, and other identifiers that are personal to you when you use certain EOS Offerings;
o information about your organization and your contacts, such as colleagues or people within your organization;
o content of feedback, testimonials, inquiries, support tickets, and any phone conversations, chat sessions and emails with or to EOS;
· Personal Information that EOS may process from other sources:
o network and connection information, such as the Internet protocol (IP) address used to connect your computer or other device to the Internet and information about your Internet service provider;
o marketing, sales generation, and recruitment information, including your name, email address, physical address, phone number, and other similar contact information;
o subscription, purchase, support, or other information about your interactions with products and services offered by EOS, EOS affiliates, or third parties (such as products offered through EOS in relation to EOS Offerings);
o search results and links, including paid listings (such as Sponsored Links); and
o credit history information from credit bureaus.
If we associate Non-personal Information with Personal Information, we will treat such information as Personal Information.
Legal basis for processing
Processing of personal information is necessary for the performance of our contractual obligations towards you and providing you with our services, to protect our legitimate interests and to comply with our legal obligations.
How EOS Uses Personal Information
EOS may use your personal information to operate, provide, and improve EOS Offerings. EOS purposes for using personal information include:
- Provide EOS Offerings: EOS uses your personal information to provide and deliver EOS Offerings and process transactions related to EOS Offerings, including registrations, subscriptions, purchases, and payments.
- Measure, Support, and Improve EOS Offerings: EOS uses your personal information to measure use of, analyze performance of, fix errors in, provide support for, improve, and develop EOS Offerings.
- Recommendations and Personalization: EOS uses your personal information to recommend EOS Offerings that might be of interest to you, identify your preferences, and personalize your experience with EOS Offerings.
- Comply with Legal Obligations: In certain cases, EOS has a legal obligation to collect, use, or retain your personal information.
- Communicate with You: EOS uses your personal information to communicate with you in relation to EOS Offerings via different channels (e.g., by phone, email, chat) and to respond to your requests.
- Marketing: EOS uses your personal information to market and promote EOS Offerings.
- Fraud and Abuse Prevention and Credit Risks: EOS uses your personal information to prevent and detect fraud and abuse in order to protect the security of EOS customers, EOS, and others. EOS may also use scoring methods to assess and manage credit risks.
- Purposes for Which EOS Seek Your Consent: EOS may also ask for your consent to use your personal information for a specific purpose that EOS communicate to you.
How EOS Shares Personal Information
Information about EOS customers is an important part of EOS business and EOS is not in the business of selling EOS customers’ personal information to others. EOS shares personal information only as described below and with its affiliates that are either subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.
- Transactions Involving Third Parties: EOS makes available to you services, software, and content provided by third parties for use on or through EOS Offerings. You can tell when a third party is involved in your transactions, and EOS shares information related to those transactions with that third party. Third-Party Service Providers: EOS employs other companies and individuals to perform functions on EOS behalf. These third party service providers for the following purposes:
- delivering EOS hardware;
- sending communications;
- assessing credit and compliance risks;
- analyzing data;
- Storing Data
- conducting customer relationship management;
- providing support.
These third party service providers have access to personal information needed to perform their functions, but may not use it for other purposes.
- Business Transfers: As EOS continues to develop EOS business, EOS might sell or buy businesses or services. In such transactions, personal information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the individual consents otherwise). Also, in the unlikely event that EOS or substantially all of its assets are acquired, your information will of course be one of the transferred assets.
- Protection of EOS and Others: EOS release account and other personal information when EOS believes release is appropriate to comply with the law, enforce or apply EOS terms and other agreements, or protect the rights, property, or security of EOS, EOS customers, or others. This includes exchanging information with other companies and organizations for fraud prevention and detection and credit risk reduction.
Location of Personal Information
EOS is located in Israel, and EOS affiliated data centers are located throughout the world. Depending on the scope of your interactions with EOS Offerings, your personal information may be stored in or accessed from multiple countries, including Israel, Europe and the United States. Whenever EOS transfer personal information to other jurisdictions, EOS will ensure that the information is transferred in accordance with this Privacy Notice and as permitted by applicable data protection laws.
How EOS Secures Information
At EOS, security is the highest priority. EOS is designing systems with your security and privacy in mind.
- EOS protects the security of your information during transmission to or from EOS websites, applications, products, or services by using encryption protocols and software.
- EOS follows the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.
- EOS maintains physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal information. EOS security procedures mean that EOS may request proof of identity before EOS disclose personal information to you.
Internet Advertising and Third Parties
EOS Offerings may include third-party advertising and links to other websites and applications. Third party advertising partners may collect information about you when you interact with their content, advertising, or services.
Access and Choice – Data Subject Rights
You may request to: (1) Receive confirmation as to whether or not Personal Information concerning you is being processed, and access your stored Personal Information, together with supplementary information; (2) Receive a copy of Personal Information you directly volunteer to us in a structured, commonly used and machine-readable format; (3) Request rectification of your Personal Information that is in our control; (4) Request erasure of your Personal Information; (5) Object to the processing of Personal Information by us; (6) Request to restrict processing of your Personal Information by us.
You can view, update, and delete certain information about your account and your interactions with EOS Offerings. If you cannot access or update your information yourself, you can always contact EOS for assistance.
You have choices about the collection and use of your personal information. Many EOS Offerings include settings that provide you with options as to how your information is being used. You can choose not to provide certain information, but then you might not be able to take advantage of certain EOS Offerings.
- Account Information: If you want to add, update, or delete information related to your account, please go to the EOS Management Console. When you update or delete any information, EOS usually keeps a copy of the prior version for EOS records.
- Communications: If you do not want to receive promotional messages from EOS, please unsubscribe or adjust your communication preferences in the EOS Management Console. If you do not want to receive in-app notifications from EOS, please adjust your notification settings in the app or your device.
- Browser and Devices: The Help feature on most browsers and devices will tell you how to prevent your browser or device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.
If you feel that your Personal Information was not handled properly, you may lodge a complaint with the applicable regulator.
However, please note that these rights are not absolute, and may be subject to our own legitimate interests and regulatory requirements.

Children’s Personal Information
EOS don’t provide EOS Offerings for purchase by children. If you’re under 18, you may not use EOS Offerings.
Retention of Personal Information
EOS keeps your personal information to enable your continued use of EOS Offerings, for as long as it is required in order to fulfill the relevant purposes described in this Privacy Notice, as may be required by law (including for tax and accounting purposes), or as otherwise communicated to you. How long EOS retains specific personal information varies depending on the purpose of its use, and EOS will delete your personal information in accordance with applicable law.

If you interact with EOS Offerings on behalf of or through your organization, then your personal information may also be subject to your organization’s privacy practices, and you should direct privacy inquiries to your organization.
EOS business changes constantly, and EOS Privacy Notice may also change. You should check the EOS website frequently to see recent changes. You can see the date on which the latest version of this Privacy Notice was posted. Unless stated otherwise, EOS current Privacy Notice applies to all personal information EOS has about you and your account. EOS will never materially change EOS policies and practices to make them less protective of personal information collected in the past without informing the affected customers and giving them a choice.
